TERMS AND CONDITIONS OF THE SELECTION CONTRACT

beBee is a registered trademark of beBee PLATFORM S.L., with NIF ESB84471838.

1. ACKNOWLEDGMENT AND ACCEPTANCE OF THE TERMS

beBee PLATFORM S.L. (hereinafter, "beBee"), a Spanish company located at Calle de la Virgen de los Peligros 11, 3rd floor, 28013 Madrid, Spain, is the owner of the worker selection service (hereinafter, the "Selection Service").

This Selection Agreement is offered to the contracting company (hereinafter, "the Company") under the terms and conditions set forth herein, and in accordance with the operational rules published by beBee. This document constitutes the entire contract between beBee and the Company, replacing any prior agreements related to the same subject.

2. PURPOSE AND REGISTRATION IN THE SELECTION SERVICE

The purpose of this contract is to establish a collaboration between beBee and the Company, whereby the latter can publish job offers and access beBee's database of resumes to locate candidates who have expressly authorized the transfer of their personal data to the Company.

To register for the Selection Service, the Company must complete the application form and accept these terms. If beBee does not reject the application within 15 days (rejection criteria: legality, professionalism, security, and solvency), the Company may begin using the service.

3. TYPES OF SERVICE

  • Free: Registered companies can publish job offers for free, within the limits set and published by beBee on its website. beBee reserves the right to accept or reject companies at its discretion.

beBee may review, modify, or remove offers that do not meet the service quality standards. In exchange for free use, companies agree to receive electronic communications and promotional information.

  • Paid (Premium Services): Companies can access paid services with additional benefits, according to the criteria established by beBee. The subscription will automatically renew each month, and the Company can cancel it at any time.
  • Ad hoc: Customized services offered by beBee to certain companies at its discretion.

4. CHANGES TO THE TERMS

beBee may modify these terms at any time to adapt the service to new conditions or needs. Changes will be notified on beBee's main page before they take effect. Continued use of the service implies acceptance of the modifications.

Additionally, beBee reserves the right to interrupt the service, in whole or in part, without liability to the Company or third parties.

5. PAYMENT

The Company will pay beBee the amounts established in the current rates corresponding to the contracted services, within the specified deadlines.

6. DISCLAIMER

The Company assumes all risks arising from the use of the Selection Service. beBee provides the service "as is" and "as available".

beBee guarantees the authenticity of the candidates' consent regarding the transfer of their personal data, exempting the Company from any claims arising from falsehood in such consent.

beBee does not guarantee that the service meets the specific requirements of the Company, nor that it is uninterrupted, secure, or error-free. It also disclaims any implied warranty of fitness, merchantability, or non-infringement.

The Company is responsible for the risks arising from downloading materials or information through beBee's system, including damage to its systems or data loss.

beBee does not guarantee the suitability or performance of the candidates selected by the Company or the results arising from the hires made.

7. LIMITATION OF LIABILITY

beBee will not be liable for direct or indirect damages, including lost profits or data loss, arising from the use or inability to use the service, even if it has been warned of the possibility of such damages.

8. PROHIBITION OF COMMERCIAL USE OR RESALE

The Selection Service is for the exclusive use of the contracting Company, which may not transfer or commercially exploit it without the express authorization of beBee.

9. USAGE AND CONDUCT CONDITIONS OF THE COMPANY

The Company agrees to publish only legal, truthful, and non-discriminatory offers and will be responsible for the content and truthfulness of the information published. It is prohibited to publish misleading, duplicate offers or those that involve costs for candidates.

Additionally, the Company agrees to:

  1. Provide truthful and updated information.
  2. Not interfere with the operation of the system.
  3. Comply with all applicable laws.
  4. Allow the use of its name and image by beBee for informational purposes.

beBee may terminate the contract immediately if the Company breaches these conditions.

10. SERVICE AND CV MANAGEMENT

The Company must pay for the contracted services. beBee may cancel any unpaid service, whether free or paid, without prior notice.

11. DATA PROTECTION

The Company authorizes the processing of its personal data in accordance with Organic Law 15/1999 and related regulations. beBee guarantees that candidates' data is processed with express consent and in accordance with current legislation.

The Company agrees to:

  • Use the data only for the purposes of the contract.
  • Not transfer it to unauthorized third parties.
  • Protect it with the required security measures.
  • Inform beBee of any requests for access, cancellation, or rectification received.

12. COMPENSATION

The Company will indemnify and hold beBee harmless against any claims arising from the improper use of the Selection Service, including legal, intellectual property, or data protection violations.

13. TERMINATION OF THE CONTRACT

Both beBee and the Company may terminate this contract at any time, without prior notice. Termination will result in the immediate loss of rights to use the service.

14. NOTIFICATIONS

All notifications must be made in writing, via email or postal mail, and will be considered valid once sent to the address provided by the other party.

15. INTELLECTUAL PROPERTY

All content provided by beBee (texts, software, images, logos, etc.) is protected by intellectual property rights. The Company may not copy, modify, or distribute such content without express authorization. Both parties retain ownership of their respective trademarks and distinctive elements.

16. GENERAL TERMS

This contract is governed by Spanish law. Any disputes will be submitted to the Courts and Tribunals of Madrid. Neither party may assign its rights or obligations without the express consent of the other, except for beBee, which may do so in the event of a merger, split, or sale of the service.

If any provision is declared invalid, the rest will remain in effect. The titles of the clauses are merely indicative and do not affect the interpretation of the contract.
